The New Zealand Work Visa process

Working in New Zealand requires meeting specific steps and requirements to ensure you’re prepared to start your new role. Understanding these key aspects will help you successfully secure the necessary permissions and begin your journey.

Step 1: Obtain a Job Offer from an Accredited Employer

Before applying for a work visa, you need a valid offer of employment from an accredited employer. Immigration New Zealand (INZ) mandates that employers hiring migrant workers must be accredited under the Accredited Employer Work Visa (AEWV) program.

Key Requirements for a Job Offer:

  • Accreditation: Your prospective employer must be accredited, demonstrating compliance with employment laws and fair workplace practices.

  • Job Offer Details: The job offer must specify the position, salary, work hours, and employment terms, ensuring alignment with NZ employment standards.

Securing this job offer is a critical first step as it establishes your eligibility for most work visas.

Step 2: Secure Work Rights Through a Visa

Once you have a job offer, the next step is to obtain "work rights" through a work visa or resident visa. Some popular options include:

  • Accredited Employer Work Visa (AEWV): Designed for individuals with a job offer from an accredited employer.

  • Specific Purpose Work Visa: Ideal for short-term roles or specialized projects.

  • Residence Visas with Work Rights: These provide long-term or permanent work eligibility, often for skilled migrants or investors.

Each visa category has specific criteria and application processes. Consulting with an immigration expert, like MILNZ, ensures you choose the right visa for your situation.

Step 3: Ensure Your Job Meets Immigration Requirements

To qualify for a work visa, your job must satisfy several key conditions:

  • Median Wage Threshold: Most roles must meet or exceed the median wage of NZD $29.66 per hour. Exceptions apply to specific industries like agriculture or caregiving, where reduced wage thresholds may be acceptable.

  • Skill, Qualification, and Experience: You may need to demonstrate you have the skills, relevant qualifications, or work experience necessary for the position.

  • Labour Market Test (if required): Some roles may require proof that no suitable New Zealanders are available for the position.

Step 4: Meet Additional Visa Criteria

Beyond securing a job offer, you’ll need to meet other visa requirements:

  • Health and Character Requirements: INZ requires you to undergo medical checks and provide police clearance certificates to confirm you meet their health and character standards.

  • English Language Proficiency: Some visa categories require proof of English language skills.

  • Documentation: Prepare documents such as your passport, job offer letter, proof of qualifications, and work experience records.

Step 5: Submit Your Work Visa Application

Once your job offer is finalized, you can apply for a work visa. The process includes:

  1. Application Submission: Apply online or through a immigration lawyer or advisor.

  2. Fee Payment: Pay the visa application fee, which varies by visa type.

  3. INZ Assessment: Immigration officials will review your application for completeness and accuracy.

  4. Decision Notification: If approved, you’ll receive a visa granting work rights in New Zealand.

Switching Employers, Job Roles, or Locations While Holding a Valid Work Visa in New Zealand

If you hold a valid work visa in New Zealand that is tied to your current employer, job role, or location, and you wish to make a change, the process may involve applying for a Job Change or, in some cases, a new work visa. Here’s a breakdown of what you need to know:

  What Is a Job Change?

A Job Change is an application process that allows you to update the details of your existing visa (such as your employer, job role, or location) without needing to apply for a completely new visa. This option can save time and effort, but eligibility depends on several factors:

  • New Job Role: The new role must still meet the requirements of your visa type.

  • Pay Rate: Your new pay rate must comply with Immigration New Zealand (INZ) policies, including any applicable minimum thresholds (e.g., the median wage requirement for certain visa categories).

  • Qualifications and Experience: Your qualifications and experience must align with the requirements of the new job.

  • Labour Market Test (if applicable): If your new role falls into a different occupation or location, a labour market test may be required to prove that no New Zealanders are available for the job.

When Is a New Visa Required?

In some situations, you may need to apply for a new work visa instead of a Job Change. This is likely if:

  • The new job role falls under a completely different visa category (e.g., moving from a Specific Purpose Work Visa to an Accredited Employer Work Visa).

  • You’re moving to a job that doesn’t meet the conditions of your current visa.

  • Significant changes in employment conditions make a new application more suitable.

  Key Steps to Take

  1. Assess Your Situation: Understand whether your new role or location change fits within the scope of your current visa conditions.

  2. Check Visa Conditions: Review the conditions of your existing visa, including job type, employer, and location restrictions.

  3. Consult an Expert: Engage an immigration lawyer to assess whether a Job Change application or a new visa is required for your circumstances.

  4. Apply for Changes: If eligible for a Job Change, submit the application to INZ with supporting documentation (e.g., job offer, employment agreement, evidence of qualifications).
